6.1) The registered members of Catalonia Trade & Investment’s Partners Network may be prescribed to provide services to companies with investment projects; however, a contract shall be signed only by the company with potential investment projects and the partner, as a provider of specialized services.
As a part of the cooperation relationship established with registered members, they are invited to prescribe the confidential, tailor-made, free-of-charge services of Catalonia Trade & Investment to their international clients and contacts, should they have any potential project or investment interest in Catalonia.
6.2) ACCIÓ undertakes to maintain the confidentiality of any personal data and information to which it gains access as part of the cooperation and not to disclose said information to third parties without the prior consent of the partner; it also undertakes to use said information only for the purposes indicated in this cooperation agreement.
6.3) The cooperation hereunder shall be effective for a term of four years from the date of signature acknowledging the beginning of cooperation, provided no reason for termination intervenes. During the term of cooperation, ACCIÓ may monitor partner’s activity and cooperation any time, through meetings with the partner if deemed necessary.
After this four-year term, should ACCIÓ wish to extend the cooperation hereunder with a registered partner for an additional term of four years, ACCIÓ shall send an email proposing partner such extension. Should partner wish to extend the cooperation, partner shall have to give an express answer to such email, attaching to the email accepting ACCIÓ’s extension proposal any evidence proving compliance by partner of any new requirement to be met to be a registered member or of any change concerning compliance of requirements to be met. If necessary, a meeting between the parties will be held. Should partner not give an answer to ACCIO’s e-mail within the term given to that purpose, cooperation hereunder shall be terminated.
6.4) ACCIÓ may cancel the cooperation agreement at any time if it becomes aware that the partner has become subject to any of the following situations:
- Malpractice: in the event that ACCIÓ receives poor reports about the partner from client companies.
- Failure to meet requirements: if ACCIÓ finds that any of the requirements are not being met or that any of the conditions that gave rise to the cooperation no longer apply.
- Non-alignment with the objectives of CT&I: in the event that ACCIÓ finds that the partner is not acting in accordance with its objectives, i.e. principally attracting foreign investment and positioning Catalonia as the best location for new productive foreign investment projects.
- Failure to maintain the confidentiality of any information provided by ACCIÓ regarding potential client companies with potential investment projects.
The foregoing notwithstanding, the cooperation agreement shall be rendered null and void if it is cancelled by the registered partner by sending a letter to this effect by reliable means to ACCIÓ.
